This Privacy Statement describes how Your Pie Franchising, LLC (“Your Pie”, “we” or “us”) collects, uses and processes the personal information we obtain about people who use the Your Pie Website or mobile apps, apply to become franchisees, browse or purchase our products, provide data to us through printed materials (such as comment cards, sweepstake entries or other mail-in offers), or who otherwise interact with us online or offline (the “Services”). 
 
In this Privacy Statement, “personal information” (a/k/a “personal data”) means any information that Your Pie processes?that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with a particular person or household.
This Privacy Statement does not apply to any websites or mobile apps that are created, run, or controlled by independently owned or operated Your Pie franchisees or any other third party. We are not responsible for the content or privacy practices of any linked websites that are not under our control
 
By downloading, using, creating an account on, or registering for our Services, or by otherwise providing your personal information to us, you are agreeing to this Privacy Statement.
 
  1. Information We Collect
 
We collect information you provide us.  To use some features of our Services (for example, to sign up for the Your Pie Rewards Program, enter contests, make a purchase, or request franchise information from us), you must register with us or otherwise provide us with your personal information. We also may collect personal information that you enter through our Services or provide to us in other ways, such as through email or text message. The types of personal information that we collect from you will depend on your interactions with us and how you use our Services, but may include:
 
  • personal details, such as full name, mailing address, email address, phone number, and other contact information;
  • purchase transaction information, such as information about the products you buy, billing address, method of payment, and payment details;
  • location data; and
  • other personal information you choose to provide to us, including through social media.
In addition, Your Pie follows a thorough, multi-step franchise application process prior to authorizing a franchised location and may collect sensitive personal information through this Website or through other electronic means during the franchise application process, including information regarding your qualifications, background, education and financial position.
We collect information through automated methods. We, and the vendors we work with, may also collect other information about your use of our Services using automated tools. For example, cookies and other passive information collection technologies enable us to compile aggregate statistics concerning use of our Services, analyze trends, enhance the security of our Services, deliver content and advertisements, and otherwise administer and improve our Services.
We may collect information about your:
  • internet protocol (IP) address;
  • computer or mobile-device operating system and browser type;
  • type of mobile device and its settings;
  • unique device identifier (UDID) or mobile equipment identifier (MEID) of your mobile device;
  • device and component serial numbers;
  • advertising identifiers (for example, an Identifier for Advertising (IDFA) on Apple devices) or similar identifiers;
  • referring webpage (a page that has led you to ours) or application;
  • online activity on other websites, applications or social media;
  • activity related to how you use our online services or in-restaurant technology, such as the pages you visit on our websites or in our mobile apps.
Our online services and in-restaurant technology may collect information about the exact location of your mobile device or computer using geolocation and technology such as GPS, Wi-Fi, Bluetooth, or cell tower proximity.  For most mobile devices and computer systems, you can disable the collection of this information by using the device or web-browser settings.  If you have any questions about how to prevent us from collecting exact information about your location, we recommend you contact your mobile-device service provider, the device manufacturer, or your web-browser provider.  Some online services and in-restaurant technology may not work properly without information about your location.
Information We Collect from Others.  We may collect information about you from our business partners, franchisees and vendors (e.g., food delivery platforms, data providers, or payment processors) or from public sources (e.g., your public social media posts). When submitting information to a third party, you are subject to that third party’s terms of use and privacy policies. Your Pie may combine information about you that we already have with information we obtain from third parties. If you submit someone else’s personal information to us, you represent that you have been authorized to provide this information to us.
Certain features of our Services may permit you to interact with social media networks operated by unaffiliated parties, for example, if you “like” or “follow” us on those platforms (“Social Features”). If you choose to “like” or share content or post information using Social Features, that information may be publicly displayed, and the party operating the social media platform may receive information about you and your use of our Services. Similarly, if you interact with us through Social Features, we may have access to information about you from the social media platform. In addition, we may track when you like us, follow us, or share our content through Facebook, Twitter, or other social media platforms.
Please note that if you mention Your Pie, or comment about or in response to us, in your post on a social media platform, that platform may allow us to publish your post on our Services or public social media pages or otherwise use your post about us. You should review the terms, policies, and settings of these platforms to learn more about their data practices and adjust your settings accordingly.

We may use the information we collect in a variety of ways. Generally, we use such information to respond to our customers, improve our products and Service, and strengthen the security of this Website. More specifically, we may use information we collect from you to:
 
  • send you marketing and other communications about Your Pie and our products;
  • notify you about upcoming promotions on this Website, Mobile App or in our restaurants;
  • review and improve our Website or Mobile App;
  • process your orders and purchases;
  • respond to your inquiries;
  • conduct marketing research;
  • personalize our content, including to make recommendations to you about our Services, to tailor the information we send or show you, and to offer location-based customizations and personalization based on your purchase history or past interactions with our Services;
  • monitor and analyze trends, usage, and the activities of users of our Services to better understand how our users access and use our Services in order to improve them, respond to user preferences, and for other research purposes;
  • improve our Services;
  • protect and improve the security of our Website or Mobile App;
  • evaluate and respond to franchise applications;
  • take any other actions and implement any other policies intended to improve our restaurants, customer service, and customer experience;
  • provide you with localized search results;
  • comply with legal obligations and our policies; and
  • achieve other purposes, with your consent (when required).
 By submitting our contact form, you agree to receive calls, text messages, automated calls, or emails from Your Pie Franchising and/or YourDoughCo at the contact information provided. If you download or use our Mobile App, you may agree to share your location information with us. We may use your location information to send you customized notices, offers, and coupons. You may later opt out of sharing your location information.
 
  1. How We Share the Information We Collect
 
We do not sell your personal information and only share your information as described in this Privacy Statement or as otherwise communicated to you at the time we collect your information. Please note that some US state statutes may define a “sale” to include sharing of personal information with third parties for valuable consideration.  Many companies have common arrangements with online advertising networks and analytics companies that may potentially be considered sales under these definitions.  Please reference our Additional Notice for California Consumers (below) for more information.
We may share your personal information with:
  • our affiliates, employees, and franchisees (collectively, the “Your Pie Family”). These disclosures generally will allow a member of the Your Pie Family to improve our restaurants and provide better Service;
  • technology service providers who use the information to detect or prevent fraud for us, and who may use the information to provide fraud detection and prevention services to others;
  • marketing agencies and third-party ad network providers, advertisers, sponsors and/or traffic measurement services;
  • buyers or other parties involved in a corporate transaction if we decide to sell or transfer all or part of our business;
  • our professional advisers such as our legal representatives, auditors and insurance brokers; and
  • business partners if they are involved in your customer experience, including product or service delivery (e.g., food delivery platforms).
We may also disclose your personal information to comply with applicable law, such as in response to requests from law enforcement agencies, regulators, other public authorities, courts, and third-party litigants in connection with legal proceedings or investigations.
We use third parties, such as network advertisers to display advertisements on our Website and Mobile App, to assist us in displaying advertisements on third-party websites, and to evaluate the success of our advertising campaigns. Network advertisers are third parties that display advertisements based on your visits to our Website as well as other websites. This enables us and these third parties to target advertisements by displaying ads for products and services in which you might be interested. Third-party ad network providers, advertisers, sponsors and/or traffic measurement services may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs, and other technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third-party cookies and other technologies are governed by each third party’s specific privacy policy. We may provide these third-party advertisers with information about your usage of our Website, Mobile App, and other services.
 
We may also participate in third-party ad networks (including but not limited to Google Ads  and Facebook Ads) and allow third parties to use cookies, pixel tags and other tracking technologies to collect usage information and display targeted ads. These third parties may be able to associate the information they collect with other information they have about you from other sources.
 
Your Pie also may disclose the personal information of applicants to third-party service providers retained by us to assist in the franchise application process. However, we will only provide such third party with the information necessary to assist us, will require such third party to protect your information, and will not allow such third party to use your information for any other purpose.
 
  1. Protecting Your Information
 
We use what we believe are industry-standard security practices to protect your personal information. Despite our efforts, however, we cannot guarantee that any personal information we collect from you will remain completely secure. No technology is foolproof, and information storage systems occasionally can be breached and accessed by third parties in violation of law. Therefore, we encourage you to use caution when using the internet or any mobile device and to take reasonable steps to protect the confidentiality of your passwords, account information, and payment information.

This Website may contain links to third-party websites that are not owned or operated by Your Pie, and you may or may not receive notice that you are leaving this Website. Your Pie is not responsible for the policies, content and practices of such third-party websites, and you visit such third-party websites at your own risk. As a result, we encourage you to refer to the privacy policies of those websites to learn more about the policies and practices of such websites.

By visiting and using our Website or our Web App, you are agreeing to the practices described in this Privacy Statement. From time to time, we may need to revise this Privacy Statement to reflect changes in our practices and policies concerning your privacy. When we update this Privacy Statement, we will post the changes immediately. Thereafter, your continued use of this Website or our Web App constitutes acceptance of our revised Privacy Statement.
 
  1. Your Rights and Choices
 
Under certain circumstances, and depending on your state or country of residency, you may have rights under applicable data protection laws in relation to your personal information.
 
  • You may request access to your personal information. This enables you to receive a copy of the personal information we hold about you as well as details about how we are processing it.
  • If you believe that the personal information about you is incorrect, incomplete or outdated, you may request the revision or correction of that information.
  • You may ask us to delete or remove personal information we hold about you, subject to certain exceptions. Please note that if you are a Your Pie Loyalty Rewards member, requesting deletion may require the deletion of your account which, upon completion, cannot be undone.
  • You may have the right to object to us processing your information in certain circumstances.
  • Under state law, we must disclose if we sell personal information to third parties for monetary or other valuable consideration, if we share personal information for cross-context behavioral advertising, or use your personal information for targeted advertising. We do not sell personal information in exchange for money; however, some of our advertising practices on our websites may be classified as sales or sharing under certain state laws. We do not sell personal information of minors for monetary or other valuable consideration. In certain jurisdictions, you have the right to opt-out of the sale or sharing of your personal information.
  • You may request the transfer of your personal information to you or a third party. We will provide to you, or a third party you have chosen, your information in a structured, commonly used, machine-readable format. If Your Pie rejects your request, you may have the right to appeal that rejection within a reasonable period. To do so, you can contact us as described in the contact section below.
Please note, not all of the rights described above are absolute, and they do not apply in all circumstances. In some cases, we may limit or deny your request because the law permits or requires us to do so, or if we are unable to adequately verify your identity. We will not discriminate against individuals who exercise their privacy rights under applicable law.
You may exercise any of these rights by contacting us.  Our contact information is listed below. In the request, please specify which right you are seeking to exercise and the scope of the request. We may require specific information from you to help us verify your identity and process your request, including your name, email address, and address. If we are unable to verify your identity, we may deny your request. Your Pie restaurants are franchised and are independently owned and operated. Their processing of personal information is subject to their own privacy policies. If you wish to exercise any of these rights with respect to the processing of information by a Your Pie restaurant, please contact your local franchised store location to make your request. We will work with the franchise owner to address your request to the extent required by applicable law.
 
  1. Children’s Privacy Notice
 
Your Pie does not knowingly request, solicit, collect, or otherwise obtain personal information from anyone under the age of 13. If we become aware that we have collected or received personal information online from anyone under the age of 13, we will delete that information from our records as soon as reasonably practicable. If you are a parent or guardian and are aware that your child has provided us with personal information online, we encourage you to contact us  at your convenience so that we can delete your child’s personal information from our record.
 
  1. Notice of Financial Incentive
Your Pie offers the Your Pie Rewards Program. Generally speaking, Your Pie Rewards participants may receive rewards points for each pizza purchased. Points may be accumulated and redeemed for purchases of eligible Your Pie products. Your Pie collects personal information in connection with providing the Your Pie Rewards Program to consumers. This includes the following categories of personal information:
  • Identifiers, such as participants’ name, email address, and Your Pie Rewards account numbers;
  • Personal information described in Cal. Civil Code § 1798.80(e), such as phone number and payment information (such as payment card details);
  • Commercial information, such as records of members’ purchases, information about actions taken while using the Mobile App, and members’ rewards account credentials;
  • Internet or other electronic network information reflecting a participants’ interaction with the Mobile App, in-restaurant technologies, or ads in connection with the Your Pie Rewards Program;
  • Geolocation data, which may be collected if participants enable their devices to collect their location (and which can be disabled at any time in device settings); and
  • Inferencesdrawn from any of the above categories of information to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, or aptitudes.
Your Pie may share this personal information with the categories of third parties listed in “How We Share the Information We Collect.” We do not disclose personal information collected in connection with the Your Pie Rewards Program to data brokers. We may disclose certain identifiers such as email addresses and pseudonymized identifiers, information about the use of our websites and apps, and inferences drawn about you to our social media, advertising and analytics partners. Under certain state laws, this may be considered a sale of personal information for consideration. We may also process and share this information for targeted advertising.
Your Pie benefits financially from the Your Pie Rewards Program through increased customer loyalty and sales, but we do not assign an independent monetary value to the personal information we collect in connection with the program. Further, the precise value each Your Pie Rewards member receives from the program can vary greatly by individual, and depends on (without limitation) (a) the number of dollars spent and points accumulated, (b) the rewards redeemed, (c) whether someone is a regular or occasional customer of Your Pie, and (d) whether participants elect to collect points for in-restaurant purchases. Some benefits to participants may also be intangible, such as the ability to streamline the ordering and/or payment process.
In general, however, Your Pie estimates in good faith that the value of the personal information that Your Pie collects through the Your Pie Rewards Program would be less than the value that the Your Pie Rewards Program provides to consumers. To the extent Your Pie calculates the value of the personal information it collects through Your Pie Rewards, it does so in good faith based on the expenses related to the collection and retention of personal information in connection with the program.
If you request that Your Pie delete your personal information, then the points and rewards you have earned will no longer be available because we will no longer be able to associate you with those points and rewards.
 
  1. Notice to California Residents Under 18 Years of Age
If you are a registered user of online services under the age of 18, and we have actual knowledge of your age, then under California law, you may request and obtain removal of certain content or information you have posted on our online services. To do so, please contact us using the contact information listed below. Please note that removal does not ensure complete or comprehensive removal of the content. For example, removal may not be possible or permitted if another provision of law requires the content to be maintained, if it was posted or reposted by others, or if we paid compensation to you in exchange for the posting.
  1. Additional Notice for Consumers in Colorado and Virginia
This part of our Privacy Statement applies to consumers who reside in Colorado or Virginia.
  1. Targeted Advertising. Your Pie processes personal information for targeted advertising. You can opt-out of targeted advertising by visiting the Digital Advertising Alliance website or the Network Advertising Initiative website .
  2. Privacy Rights.Under applicable law, you may have the following rights, in each case under the conditions and to the extent set out in applicable law:
  • Right of Access:A right to confirm whether Your Pie is processing personal information about you, and to request access such personal information (including, if applicable, in a portable and readily usable format).
  • Right of Correction:A right to correct inaccuracies in certain personal information Your Pie may hold about you; and
  • Right of Deletion: A right to request that Your Pie delete personal information concerning you. Please note that if you have requested a service that requires the use of your personal information, we may not be able to provide that service if you choose to delete your personal information.
If any of the above rights are available to you under applicable law, you can submit a request to exercise your rights by contacting us.
If your rights request is denied, applicable law may give you the right to lodge an appeal with us.  The response to your rights request will inform you of any appeal rights you may have and tell you how you can exercise them.
  1. Additional Notice for California Consumers
This part of our Privacy Statement applies to consumers who reside in the State of California.
  1. Personal Information We Collect About California Consumers. We describe the personal information we have collected about California consumers in the part titled, “Information We Collect.” The information we obtain includes the following:
  1. Identifiers such as name, postal and email addresses, internet protocol (IP) address, social media handles, username, password and other contact information used to register and access Your Pie products and services, log-in to Wi-Fi, enter one of our competitions, or contact us by phone or through our online services. The following categories of personal information described in California Civil Code § 1798.80(e):
    1. the personal information listed above as identifiers;
    2. signatures;
    3. telephone number;
    4. payment information (including payment card details or online payment services number and invoicing address) and financial information (such as bank account numbers);
    5. physical characteristics or description; and
    6. the other information that identifies, relates to, describes, or is capable of being associated with, a particular individual that we describe in “Information We Collect.”
  2. Commercial information, including:
    1. records of products or services purchased or received from Your Pie;
    2. username, password, or other account information used to obtain access to Your Pie’s online services;
    3. information on actions taken on Your Pie’s website or mobile app, which may include information about Your Pie’s products or services considered and the times you visit our websites or use or mobile apps; and
    4. information about consumer preferences and behavior that we collect on our website and mobile app in order to target consumers for digital advertisements or to personalize content we deliver on our websites and mobile apps.

Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an Internet Web site, application, or advertisement, as well as the information listed above in the section titled “Information We Collect:”
    1. computer or mobile-device operating system and browser type;
    2. type of mobile device and its settings;
    3. unique device identifier (UDID) or mobile equipment identifier (MEID) for your mobile device;
    4. device and component serial numbers;
    5. advertising identifiers (for example, IDFAs and IFAs) or similar identifiers;
    6. referring website (a site that has led you to ours) or application;
    7. online activity on other websites, applications or social media; and
    8. activity related to how you use our online services, such as the pages you visit on our sites or in our mobile apps.
  4. Geolocation data.
  5. Characteristics of protected classifications under California or federal law, such as demographic information like age or gender.
  6. Audio information from calls placed with customer service centers which may be recorded, and electronic information in the form of Internet or other electronic network activity information as described above.  When you visit our restaurants, we may also capture video information via CCTV cameras that help us monitor restaurant safety.
  7. Inferences drawn from
    1. the information we collect when you visit our websites, use our apps, interact with our official social media pages, or otherwise interact with us;
    2. information we collect, including through third-party suppliers, regarding content and other data posted on the Internet (such as public locations on the Internet); and
    3. information about consumer preferences and behavior that we collect on our websites and mobile apps or purchase from third parties in order to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, or aptitudes.
  8. Sensitive personal information, such as account login credentials when combined with passwords, and precise geolocation data, as described above. If you win a competition, contest, prize draw, or sweepstakes, we may also collect your social security number and driver’s license or state identification card as part of legal compliance.
We collect this personal information directly from you when you provide information to us, for example, when registering for or using our online services, logging into Wi-Fi, using our in-restaurant digital channels, entering one of our competitions, or contacting us; from your computer system or mobile device when you use our online services, visit our restaurants, or use in-restaurant technologies; from other companies and organizations, such as our advertising agency partners, social media networks, data brokers, payment processors, and other providers and from publicly available sources.  For more information, please review “Information We Collect.”
  1. Use of Personal Information. We use the personal information we collect about California consumers for the business purposes disclosed within our Privacy Statement.  For more information, please review “Use of Information.”
The business purposes for which we may use personal information about California consumers include:
  1. Audits and reporting relating to particular transactions and interactions, including online interactions, you may have with us or others on our behalf, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance;
  2. Helping to ensure security and integrity while using personal information as may be reasonably necessary and proportionate, including detecting and protecting against security incidents, and malicious, deceptive, fraudulent or illegal activity, and prosecuting the same;
  3. Debugging to identify and repair errors in our systems;
  4. Short-term, transient use including contextual customization of ads;
  5. Providing services on our behalf or on behalf of another, including maintaining or servicing accounts, providing customer service, fulfilling transactions, verifying identity information, processing payments, and other services. This includes:
    1. Conducting internal research to develop and demonstrate technology; and
    2. Conducting activity to verify, enhance, and maintain the quality or safety of services or devices which we may own, control, or provide.
We may also use the information we collect for our own or our service providers’ other operational purposes, purposes for which we provide you additional notice, purposes disclosed elsewhere in this Privacy Statement, or for purposes compatible with the context in which the personal information was collected.
We may de-identify personal information about you or receive de-identified personal information about you, and we may use and disclose such information for any purpose in accordance with applicable law. We will maintain de-identified information in de-identified form, and will not re-identify such information, except in accordance with the requirements of applicable law.
  1. Disclosures of Personal Information. As is common practice among businesses that operate Internet websites and mobile apps, within the past 12 months, we may have shared certain identifiers such as email addresses and pseudonymized identifiers, information about the use of our websites and apps, and inferences drawn about you to our social media, advertising, and analytics partners. Under certain state laws, this may be considered to be a sale of personal information for consideration and/or the sharing of personal information for cross-context behavioral advertising. We do not disclose personal information of individuals we know to be under the age of 13 to other businesses or third parties for consideration or for cross-context behavioral advertising.
We have disclosed personal information in all or substantially all of the categories identified in this Additional Notice for California Consumers to members of the Your Pie Family, vendors who provide services to us, and as otherwise provided in “Use of Information.”
  1. Your California Consumer Privacy Act (CCPA) Information, Deletion, and Correction Rights. If you are a California resident, you have the following rights.  We will honor requests received to the extent required by applicable law and within the time provided by law.
  2. Right to Access, Right to Correction, and Right to Deletion
  3. Right to Access and Right to Know regarding personal information.You have the right to request that we disclose the following to you:
    1. the categories of personal information we have collected about you;
    2. the categories of sources from which the personal information is collected;
  • our business or commercial purpose for collecting or selling personal information;
  1. the categories of third parties with whom we share personal information; and
  2. the specific pieces of information we have collected about you.
  3. the categories of personal information about you, if any, that we have disclosed for monetary or other valuable consideration and the categories of third parties to which we have disclosed the information, by category or categories of personal information for each third party to which we disclosed the personal information; and
  • the categories of personal information about you that we disclosed for a business purpose.
  1. Right to Deletion of personal information.  You have the right to request that we delete personal information about you that we have collected from you. Please note if you have requested a service that requires the use of your personal information, we may not be able to provide that service if you choose to delete your personal information.
  2. Right to Correct. You have the right to request that we correct personal information that we maintain about you that is inaccurate.
For requests made in connection with the Right of Access, Right to Know, Right to Correct, and/or Right of Deletion, please note that, as required under applicable law, we must take steps to verify your request before we can provide personal information to you, correct or delete personal information, or otherwise process your request.  To verify your request, you must provide your name, email address, and state of residence, and you may also have the option to provide your phone number.  If we believe we need further information to verify your request as required by law, we may ask you to provide additional information to us.
We will process your request within 45 days after receipt of a verifiable request, unless we notify you that we require additional time to respond, in which case we will respond within such additional period of time required by law.  If your request involves us providing personal information to you, we may deliver the personal information to you through your account, if you maintain an account with Your Pie, or electronically or by mail at your option.  If electronically, then we will deliver the information to you or, if you so request and if permitted by law, to another entity, in a portable and, to the extent technically feasible, in a structured, commonly used, machine-readable format that allows you to transmit the information from one entity to another without hindrance.
  1. Right to Opt Out of Sales or Sharing. You have the right to opt out of the disclosure of personal information about you for consideration and the sharing of personal information about you for cross-context behavioral advertising. You can visit the opt-out tools provided by the Network Advertising Alliance  and the Digital Advertising Alliance .
Your Pie will process opt-out requests submitted by a consumer’s opt-out preference signal as required by applicable law. You can learn how to set up and use an opt-out preference signal by visiting the California Attorney General’s CCPA page , and consulting the section titled “Requests not to Sell Personal Information (Right to Opt-Out of Sale).”  You can also consult information published by the California Privacy Protection Agency about how you can set up and use opt-out preference signals.
  1. Right to Non-Discrimination.We may not discriminate against you because of your exercise of any of the foregoing privacy rights, or any other rights under the CCPA, including by:
  2. Denying you goods or services;
  3. Charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
  4. Providing you a different level or quality of goods or services; or
  5. Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services.
We may, however, charge different prices or rates, or provide a different level or quality of goods or services, if that difference is reasonably related to the value provided to Your Pie by your personal information.
  1. Requests to Exercise Your Rights.
